Terms of Use

These Terms form a binding agreement between you and affbid. They apply to everyone who accesses the Service, whether you only browse listings or submit and pay to publish your own. Our Privacy Policy is incorporated into these Terms by reference.

affbid is a paid ranking directory. Listings are organized into categories; within each category, position is determined entirely by the amount paid — the listing with the highest cumulative payment in a category holds the top spot. A listing keeps its position indefinitely, until another listing pays more to outbid it. There is no subscription and no fixed placement period: your rank is a direct, continuous function of the highest amount paid, by anyone, at any time.

The Service does not use conventional user accounts. Instead, each listing you submit generates a private, unique management link that lets you edit the listing or top up its bid. This link is the only way to manage your listing — if you lose it, we generally cannot recover it for you (see Section 4).

You must be at least 18 years old, and have the legal capacity to enter into a binding contract, to use the Service or submit a payment. By using the Service you represent that you meet these requirements and that your use of the Service does not violate any law or regulation applicable to you.

When you submit a listing, you are solely responsible for the accuracy of the title, description, contact details, and destination URL you provide, and for keeping your management link confidential — anyone who has it can edit or top up your listing. We are not responsible for losses arising from a management link you shared, lost, or failed to secure.

You represent and warrant that you have the right to submit the content and link you provide, that the content is accurate and not misleading, and that the destination of your link is what your listing describes it to be.

Some categories on the Service relate to businesses and services in the online-traffic and performance-marketing industry, some of which operate in legally or commercially sensitive areas depending on jurisdiction. Inclusion of a category or listing on the Service is not an endorsement, certification, or verification of the legality, safety, or quality of any listed service — see Section 8 and Section 10.

Payments are processed by our third-party payment processor. We do not collect or store your full card details — payment data is handled directly by the processor under its own terms and privacy practices.

Ranking is awarded strictly by amount paid; we do not guarantee any specific amount of traffic, clicks, visibility, or business outcome from a listing or its rank. Because publication and ranking take effect immediately upon successful payment, all payments are final and non-refundable once your listing is published or your bid is applied, except where a refund is required by law that cannot be excluded by agreement. If you believe a payment was made in error, contact us at the address in Section 16 as soon as possible.

You may not submit, publish, or link to content that:

• is illegal under the laws applicable to you or to us;
• contains malware, phishing pages, or other content designed to compromise a visitor’s device or accounts;
• infringes another party’s intellectual property, privacy, or other legal rights;
• materially misrepresents the product, service, or destination it links to;
• facilitates fraud, or the sale of stolen data, stolen access, or counterfeit goods; or
• sexually exploits or endangers minors, in any form.

You also may not attempt to manipulate the Service’s ranking mechanism outside of paying through the normal submission and bidding flow (for example, exploiting a bug to inflate a rank without payment), or attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure.

We may review, decline to publish, place under review, suspend, or permanently remove any listing at our sole discretion, including after payment, if we believe it violates these Terms, applicable law, or poses a risk to the Service or its visitors. Where reasonably possible we will attempt to notify you through the contact details you provided, but we are not obligated to do so before acting. Removal for a violation of these Terms does not entitle you to a refund.

The Service is, by design, a directory of links to third-party websites and services that we do not operate, control, or supervise. We are not responsible for the content, security, business practices, or legality of any linked site, and linking to a site is not an endorsement of it. You access third-party sites entirely at your own risk and subject to their own terms and privacy policies.

The affbid name, logo, design, and underlying software are our property or that of our licensors and are protected by intellectual property law. These Terms do not grant you any right to use them beyond ordinary use of the Service. By submitting a listing, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and reproduce the content you submit (title, description, image, and link) for the purpose of operating and promoting the Service, for as long as your listing remains published.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any listing’s rank will produce any particular result.

To the fullest extent permitted by law, affbid and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold affbid and its operators harmless from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or related to: your listing or its content; your violation of these Terms; your violation of any law or the rights of a third party; or your use of the Service.

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for a violation of these Terms. Sections of these Terms which by their nature should survive termination (including Sections 8 through 12 and 14) will survive.

These Terms are governed by generally applicable principles of contract law, without regard to any particular jurisdiction’s conflict-of-law rules, except where a mandatory local consumer-protection law applicable to you provides otherwise. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
